LIABILITY WAIVER
In consideration of myself, 'player I have signed up through this registration platform', and any "relationships listed on this registration platform' being allowed to participate in any Dags Basketball Programs, Training, and Workouts, or any other related activities (“Programs”) provided by Dags Basketball (Formerly Dagostino Brothers, INC.) undersigned acknowledges, appreciates, and agree that: The risk of injury from the activities involved in these Programs is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of Dags Basketball and any facilities used, their officers, officials, agents, representatives, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, (“Releases”), or others, and assume full responsibility for my participation. I, for myself and on behalf of any of heirs, assigns, personal representatives and next of kin, hereby release, indemnify, and hold harmless Releases with respect to any and all injury, disability, death, or loss or damage to person or property, whether arising from the negligence of the Releases or otherwise, to the fullest extent permitted by law. I, for myself and on behalf of any of heirs, assigns, personal representatives and next of kin, hereby release, indemnify, and hold harmless all of the above Releases from any and all liabilities incident to my involvement or participation in these Programs, even if arising from their negligence to the fullest extent permitted by law. I grant permission for the camp directors to act on my behalf in case of medical emergency. I understand that I am responsible for all medical expenses. I also grant permission for my child to appear in Program photos or video highlights.

COVID 19 RELEASE WAIVER AND LIABILITY AGREEMENT

Section 1. General Release

By signing this agreement, you hereby release and discharge Dags Basketball, from any and all claims, causes of action or liability for any injuries that you or your child(ren) may suffer resulting from participation in an Dags Basketball sponsored event or workout, or through the use of Dags Basketball facilities, (including but not limited to MD Sports Hall, 411 Union Street, Avon Crest Park, Burgess Kimball Park) whether or not the claims, causes of action or liability arise out of, or result from, any act, omission, or conduct of any of Dags Basketball employees, representatives, contractors, vendors, volunteers, agents, owners, investors, other program participants or their families, (hereinafter “Dags Basketball Parties”).

Section 2. Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly through person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Dags Basketball has put in place preventative measures to reduce the spread of COVID-19, however, Dags Basketball cannot guarantee that you and/or your child(ren) (or other family members) will not become infected with COVID-19. Further, attending a Dags Basketball facility or an Dags Basketball sponsored activity could increase your risk and/or your child(ren)’s (or other family member’s) risk of contracting COVID-19. By signing this agreement, you acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that you and/or your child(ren) and other members of your family may be exposed to or infected by COVID-19 by attending the facilities of Dags Basketball or through attendance at other Dags Basketball sponsored activities and that such exposure or infection may result in personal injury, illness, permanent disability, or death. You also understand that the risk of becoming exposed to or infected by COVID-19 may result from the actions, omissions, or negligence of Dags Basketball Parties.

By signing this agreement, you also voluntarily agree to assume all of the foregoing risks, including financial risks, and accept sole responsibility for any injury to yourself and/or your child(ren) (or other family members) including, but not limited to, personal injury, disability, death, illness, damage, loss, liability, or expense, of any kind, that you or your child(ren) (or other family members) may experience or incur in connection with your own or your child(ren)’s attendance at Dags Basketball facilities or through participation in Dags Basketball sponsored programming (“Potential Claim”). On your behalf and on behalf of your children (and other family members), you hereby release, covenant not to sue, discharge, and hold harmless Dags Basketball and Dags Basketball Parties, collectively and individually, from all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating to a Potential Claim. You understand and agree that this release includes any Potential Claim based on the actions, omissions, or negligence of Dags Basketball or Dags Basketball Parties, whether a COVID-19 infection occurs before, during, or after participation in any Dags Basketball program or at an Dags Basketball facility.

COVID-19 GUIDELINES

Please enter gym no earlier than 5 minutes prior to session.

Players must be picked up from facility no later than 5 minutes after the end of the session.

For 1 on 1 sessions, 1 parent is allowed in the gym

For any sessions with more than 1 player, no parents are allowed in the gym.

PLAYERS MUST BRING THEIR OWN BASKETBALL
